Court Decision @ 6:32:00 PM
Finally ! A decision is made ! Although the whole case isn't over yet,
but I do think it'll be soon. Come to think of it, DBSK is kind of like..
what do you call it.. a Korean representative. Why would they get rid of
them (stupid me). Okay, maybe that's just my point of view and a way to
make myself feel better.
Okay, so basically, the temporary decision is in favour to DBSK (it's not
to say it's temporary, more like the decision made at this point)
Because of all the law terms and stuff, I have actually not much of a clue
to what the result is accurately, so don't kill me if what I put
isn't way off from what others say LOL. (then why am I sharing if I don't
know.. -_-)
According to what I've googled, the court has decided to permit the charges
that terms that JaeSuChun has pressed charges for. SM will also not be
allowed to interfer with the three's individual activies. The court says that SM's
exclusive contract has violated the good customs and social order and so
the contract will be partially void or completely void. But because of
the contract being not only an individual agreement but a group
agreement, the contract cannot be made completely void to continue
group activities.
Also, the parts about income splitings, I don't really understand
all that but it seems like the court has given the rights to settle the
case to JaeSuChun so how DBSK will be from now really depends on them.
Jaejoong, Junsu and Yoochun have no plans to be starting their individual
activites and will not until the whole issue is settled and after
discussing it with the other members.
Um, what else. Right, the decision made was only for the.. um.. remember
how the court (or was it SM?) who requested that all of DBSK's group
activites to be suspended until the issue is over? Well the decision was
for that part of the lawsuit.. and um, so that's consider violation of
human rights or something and so the exclusivity of that contract is now
void.
It must be hard to be a lawyer, sigh.
I'll look up more stuff and try and make myself understand it enough. If
anyone sees anything wrong, do tell me !
